1. Scope

1.1 These Terms and Conditions (hereinafter "T&Cs") of Deputy Department GmbH (hereinafter "Seller") apply to all contracts concluded between the Seller and a consumer or business (hereinafter "Customer") regarding the goods presented in the Seller's online shop.
1.2 A consumer is any natural person who enters into a transaction for purposes that are predominantly not related to their trade, business, or profession.
1.3 A business is any natural or legal person or partnership acting in the exercise of its trade, business, or profession when entering into a transaction.


2. Contract Conclusion

2.1 The product descriptions in the Seller’s online shop do not constitute binding offers. Instead, they serve as an invitation to the Customer to submit a binding offer.
2.2 The Customer may submit an offer via the online order form. By clicking the button to complete the order process, the Customer submits a legally binding offer for the goods in the shopping cart.
2.3 The Seller may accept the Customer's offer within five days:

  • By sending an order confirmation via email;
  • By delivering the goods; or
  • By requesting payment from the Customer.
    If none of these occur within five days, the Customer's offer is considered declined.
    2.4 Details regarding payment methods such as PayPal and Stripe are included, with the acceptance of the offer taking place upon successful payment initiation.
    2.5 The contract text is stored by the Seller and sent to the Customer after the order is placed.

3. Right of Withdrawal

Exclusions:

  • Archive products cannot be canceled, returned, or exchanged.
  • Pre-order products cannot be canceled, returned, or exchanged. Customers acknowledge shipping timeframes of 4–12 weeks when making a purchase.

General Withdrawal Policy:
Customers have the right to withdraw from the contract within 14 business days without providing a reason. The withdrawal period begins:

  • On the day the Customer or a third party (other than the carrier) takes possession of the goods.
  • For multiple items in one order delivered separately, from the day the last item is received.

To exercise the withdrawal right, use the contact form provided.
Exceptions: No returns are accepted for underwear, socks, or swimwear due to hygiene reasons.


4. Prices and Payment Terms

4.1 All prices include applicable VAT. Shipping costs are displayed separately.
4.2 Additional costs may apply for deliveries outside the EU (e.g., import duties, currency exchange fees), which are borne by the Customer.
4.3 Payment methods include PayPal, Stripe, and SOFORT, details of which are provided during the order process.


5. Delivery and Shipping Conditions

5.1 Deliveries are made to the shipping address specified by the Customer.
5.2 The Customer bears the costs of failed deliveries due to incorrect address details or absence unless exercising their right of withdrawal.
5.3 Risk of accidental loss or damage transfers to the Customer:

  • For consumers: Upon receipt of the goods.
  • For businesses: Upon handover to the carrier.

6. Retention of Title

The Seller retains ownership of the goods until full payment has been received.


7. Liability for Defects (Warranty)

7.1 The legal warranty rights apply.
7.2 For businesses:

  • The warranty period for new goods is one year from delivery.
  • No warranty applies to used goods unless agreed otherwise.
  • Warranty claims are subject to prompt notification of defects.
    7.3 For consumers, visible shipping damages should be reported to the delivery service and the Seller promptly.

8. Applicable Law

All legal relations are governed by the laws of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).


9. Alternative Dispute Resolution

9.1 The European Commission provides a platform for Online Dispute Resolution (ODR), accessible at: https://ec.europa.eu/consumers/odr.
9.2 The Seller is not obligated to participate in dispute resolution before a consumer arbitration board.
